The Pittsburgh Technology Council is pleased to introduce an exciting series of virtual events on the pressing international trade compliance topics of the day presented by the Dentons Cohen & Grigsby P.C. Trade Group. 

The global trade environment has changed in significant ways in recent years, with an increase in trade protectionism, new export controls around critical emerging technologies, and competition and conflict between great powers over who will drive the new economy.  This trend seems likely to continue in many regards despite the outcome of the recent U.S. presidential election.  

This series aims to provide companies with some of the knowledge and tools that are needed to successfully navigate turbulent trade waters in 2021 and beyond.  Each session will last approximately one hour and will include time for Q&A and virtual networking.

Who Should Attend:
This virtual event is appropriate for all technology and manufacturing companies doing business with the DOD or buying/selling internationally. Your registration will give you access to all sessions in this series. You may have different company representatives participate in each session and there is no limit on the number of representatives from your company that attend.

Technology Control – Deemed Exports and the Release of Technology/Technical Data
March 11, 2021 at 10:00 a.m.
Presenters: Bruce Chiu and Steve Harris
This webinar will focus on the export controls related to technology and technical data under the ITAR and EAR, including how they relate to DOD cybersecurity regulations, what constitutes a “release” of technology and the concept of deemed exports.  We will also discuss the key aspects of a good technology control plan. This session will be of particular importance to companies that employ foreign nationals.

Customs Tariff Engineering and Supply Chain Planning
March 30, 2021 at 10:00 a.m.
Presenters: Susanne Cook and Megan Finkelstein
Tariff engineering is the process of restructuring your supply chain or reclassifying your imports to legally achieve the most favorable duty rate.  We will focus on opportunities to mitigate tariff liability by focusing on ways to engineer changes to country of origin and HTS classification in order to take advantage of free trade agreements and lower duty rates and to avoid trade remedy tariffs (e.g. ADD/CVD and Section 301), as well as touch on Foreign Trade Zones (FTZs), temporary importation under bond (TIBs) and duty drawback.

China – The New Export Control Law and Unreliable Entity List

We are excited to have Ken Dai from Dentons China join us to offer his insight on China’s new Export Control Law, which represents the first effort of its kind by China to launch a unified and comprehensive export control regime.  The Export Control Law, together with China’s new Unreliable Entity List, will have significant implications for foreign companies operating in China and may also introduce new supply chain disruptions for companies that are dependent upon newly controlled Chinese exports.

Emerging and Foundational Technology Regulations

The U.S. Export Control Reform Act introduced the framework for new export controls on emerging and foundational technologies that will be key to U.S. national security going forward.  Targeted technologies include biotechnology, artificial intelligence, additive manufacturing, robotics and others.  Learn the current state of play and what this means for companies that operate in the emerging and foundational technology space, including the impact on foreign investment under the Committee on Foreign Investment in the United States (CFIUS) regulations.

The Trade Consequences of Brexit

As the UK’s unwinding from the EU continues in full effect, we are excited to have Roger Matthews of Dentons’ London office join us to offer his insights on the trade consequences of Brexit including how clients, both in the UK and abroad, can best adapt to the new reality. This session will touch on issues related to export controls, trade sanctions, tariffs, free trade agreements, trade remedies and mutual recognition.

She is a business and corporate lawyer focusing her practice on counseling companies on international and domestic M&A transactions, joint ventures, emerging business, corporate governance, customs, export and licensing matters. She has been included in The Best Lawyers in America© for International Trade and Finance Law, and was selected to the Pennsylvania Super Lawyers list. Most recently, Susanne was named the 2018 and 2020 International Trade and Finance Law “Lawyer of the Year” in Pittsburgh by Best Lawyers.

Bruce Chiu - Bruce devotes his practice to export control and sanctions compliance, U.S. Customs, CFIUS, international business transactions, data privacy and cybersecurity, E-commerce, and general corporate matters. He is a corporate lawyer and founded the Dentons Cohen & Grigsby Data Security, Privacy and Information Law Group.

Megan Finkelstein - Megan is a consultant with extensive experience in U.S. Customs and Border Protection (CBP) compliance, Free Trade Agreements, trade advisement relative to other U.S. Federal Agency requirements, foreign Customs and export control requirements. Her comprehensive experience spans all aspects of both civil and criminal Customs law. Prior to joining Dentons Cohen & Grigsby, Megan was a Customs Import Specialist and Special Agent for the U.S. Customs Service in Philadelphia and Pittsburgh.

Steven Harris - Steve is a member of the Corporate group with a focus on International Business. He provides his clients with practical advice and guidance on all manner of import, export control and other trade compliance-related matters, including advice relating to the recently enacted Section 232 (steel and aluminum) and Section 301 (China) tariffs. He formerly served as Corporate Counsel and Director of International Trade Compliance for II-VI Incorporated, where he oversaw a corporate trade compliance department for a publicly traded engineered materials and laser technology company with 9,000 employees operating in 14 countries.

Thomas Maxson - Tom counsels clients in various aspects of commercial finance, bankruptcy, the Uniform Commercial Code, and creditors' rights including secured lending transactions, preference and fraudulent transfer actions, mortgage foreclosures, enforcement of judgments, import and export control matters, collection matters, commercial lien disputes and general corporate transactions. Tom is a Shareholder in the Restructuring Insolvency and Bankruptcy
group and the Trade group.

Ken (Jianmin) Dai – Ken is the Co-Chair of the Antitrust Practice Group of Dentons China and is based in Shanghai. As one of the first lawyers focusing on antitrust law in China, Ken has more than 10 years of practical experience in this area. In addition, he is one of the pioneering lawyers practicing law in the area of data protection, privacy, cybersecurity, and export controls in China. 

Roger Matthews – Roger is a partner in Dentons’ London office, and is a member of the International Trade, EU Regulatory, Brexit and Government Affairs practice groups. He advises on international trade matters, including export controls and financial and trade sanctions.  His clients include businesses involved in international trade across all sectors, financial services institutions and government bodies, both from UK and across the globe.  He is currently particularly focused on helping clients to adjust to the trade implications of UK and EU becoming separate jurisdictions, and he brings with him extensive relevant previous experience, having served at the European Commission (on trade and sanctions), and as a legal adviser on sanctions and EU financial regulation to both HM Treasury and the Bank of England in the UK.
